The Commission’s work over the course of the pandemic raised the following: • Privacy rights engaged in the scoping of ‘Vaccine Certificates’ and the implications of digital contact tracing technology.9 This also included consideration of the proportionality of their use, impacts on freedom of movement, freedom of belief and data processing. [...] The SNP manifesto for the 2021 Scottish Parliament elections committed to a “statutory, person-centred and human rights based public inquiry.”15 However the Commission and many civil society voices raised significant concern about the inquiry’s approach to human rights and equalities.16 Following the resignation of the first Chair of the inquiry for personal reasons, the Terms of Reference were re. [...] The Commission recommends that the Scottish Government and the Scottish Parliament consider whether the mandate, powers, and resourcing of the NHRI are sufficient to protect the human rights of all in Scotland. [...] Proposals for the Bill have recently been consulted on and the Scottish Government is committed to introducing legislation in the first half of 2024.37 In response to the consultation, the Commission recommended that careful consideration should be given to the legal approach to incorporation, emphasising the need to avoid a weakening of international treaty protections and preventing undue comple.
