These amici write to explain how the decisions below are contrary to their experience and the overwhelming consensus of the scientific and medical community that medication abortion is one of the safest medication regimens in the United States and around the world. [...] The Fifth Circuit’s decision ignores the overwhelming consensus of the scientific and medical community that medication abortion is one of the safest medication regimens in the United States and around the world. [...] Since its approval, more than five million people in the United States have used mifepristone for medication abortion and miscarriage management, and the two-drug medication abortion regimen approved by the FDA accounts for most abortions in the United States today. [...] First, it updated Mifeprex’s labeling to increase the gestational age limit from forty-nine to seventy days, reduced the number of in-person clinic visits to one, changed the dosing of Mifeprex and misoprostol, and allowed for the prescription of the drug by a broader set of healthcare providers. [...] The FDA modified the REMS in 2016 and in 2023 precisely because of the overwhelming evidence of mifepristone’s safety.
