The more open the regulation of digital trade in an economy is, and the more harmonized the regulation is in the region, the faster digital economy integration comes. [...] The reason why the AHS also incorporates the preferential tariff is that the index seeks to measure the actual level of tariffs applied to the ICT products. [...] Such use is considered fair in light of several factors sch as 1) the purpose and character of the use, 2) the nature of the copyrighted work, 3) the amount and substantiality of the portion taken, and 4) the effect of the use upon the commercial market.
