Article 89 of the horizontal regulation states that the administrative penalties shall be applied by means of reduction or exclusion of the total amount of the payments. [...] For the calculation of those reductions and exclusions, account shall be taken of the severity, extent, permanence or reoccurrence and intentionality of the non-compliance determined… The administrative penalties imposed shall be effective, proportionate and dissuasive. [...] It is true that the same Article 89 says that the provisions of Article 85 (2), (5), (6), referring to percentages of 3 or 10%, apply mutatis mutandis to penalties, but it is also true that the same provisions refer to percentages that apply to environmental and animal welfare violations. [...] For instance it seems obvious that the intentional violation of Article 3 - 4 or 5 of the Transparent and predictable working conditions Directive (here) cannot be compared to the violation of Article 7 of the work equipment directive (article that talks about ergonomics).
