Information gathering for assisting the European Commission in complying with its obligations under Article 40 (“reporting”) of Regulation (EU) 2017/2394 on Consumer Protection Cooperation :Final report

Article 40 of the CPC Regulation obliges the European Commission to submit to the European Parliament and the Council a report on the CPC Regulation by 17 January 2023, including an evaluation of its application. The overall objective of this study was to provide an evaluation of the current CPC Regulation applied since 17 January 2020. The study provides evidence of the effectiveness of enforcement under the Regulation, in particular as regards the minimum powers for competent authorities, examines how compliance by traders with the relevant consumer laws has evolved in key consumer markets concerned by cross-border trade, discusses the evolution of key consumer markets and the potential difficulties arising from those trends as well as estimates the costs incurred by different stakeholders (such as CPC authorities, traders subject to a CPC action, consumers and entities able to issue external alerts). The study will also allow the European Commission to comply with its reporting obligation under Article 40 of the CPC Regulation, in particular by gathering information on Member States’ enforcement capacities, the evolution of consumer markets and stakeholders’ views.
