In Section 2, the briefing turns to consider the jurisprudence of regional courts on the right to respect for private and family life, with a focus on the European Court of Human Rights (ECtHR) and the Court of Justice of the European Union (CJEU). [...] An interference with Article 8 must strike a fair balance between an individual’s right to protection under the ECHR and the interests of the Contracting State,35 and the margin of appreciation afforded to States “will vary in the light of the nature of the issues and the seriousness of the interests at stake”.36 States’ margin of appreciation in cases concerning vulnerable persons, such as statel. [...] In the reasoning behind some of the CJEU’s case law on this matter, the CJEU noted that according to the European Court of Human Rights, the ECHR protects the right to family life that the child enjoys with their parents.46 The CJEU has also assessed whether Member States’ decisions complied with Article 7 CFR in the context of deprivation and loss of nationality.
